I know there was another thread about this and that thread has been closed. I need updated info on this since it seems to generate really good CTR. I know you can't put pictures beside AdSense to misslead people into clicking but can you put pictures above AdSense, that is my question. My guess is that the underlying concept of google TOS is that ads by google should be "displayed explicitly" and should not be out in a manner which might attract accidental clicks. Rest is all personal choice.
Look at the old dp thread because he has a picture posted of how his webpage looked like. He has it on the bottom of the page though. I was thinking about putting it in the header. I run an adsense leader board across the top of my page. Even though it runs across the top of the page, it can serve up to 4 ads. I have seen it serve 1, 2, 3, and 4 ads at once. I was thinking of putting 4 pictures in the header just above the adsense leader board. It won't be much different the picture on the old thread but it will be at the very top instead.
Mock up a dummy page, tell Google it isn't live, and ask them if the page would be within Policies. If you just slap 4 images above the ads like the original post displayed, then five will get you ten that Google will tell you no, but it doesn't hurt to ask. And save the receipt.
Most probably they will say that it is not allowed. It is rather a misleading way of encouraging clicks.
Ok what do you think now. I solved the delima of putting a picture above my banner. This way is truely easy. I am going to put pictures above my ads but its gonna be a banner picture ad from Google, so I am serving a picture on top of my ads but the picture is another ad from Google. Its actually a referral banner ad. Now I just have to tweak it to serve more then just Lulu.com ads. If you want to see how it looks, check out the link in my signature.
you can put images next to ads as long as there's a border around the ads. That's what I think was the consensus lately.

well, i am serving a Google gif banner ad on top of a headerboard of the same size so there is a picture above the headerboard but the picture is another Google .gif banner ad.
