My friend owns a .US domain unknowingly

Discussion in 'Legal Issues' started by bigicon, Jun 11, 2010.

One of my friend when he was new to domaining bought a US domain from a seller (not the domain registrar) without knowing that he should not own a .US domain as he is not a us citizen.

Now he want to sell it in SEDO or any other market place. (It will be atleast $300)

    Can he sell it?

    Or what can he do.

As you know, legally he isn't supposed to own the domain. Practically speaking, it isn't usually enforced unless someone was to challenge it. I don't think there is any problem in him selling it on SEDO. If before he sells it, someone objects, then that would be a different story - but that doesn't have anything to do with them offering it for sale.

Do you know any other site where we can sell .US domains? I mean no need of seller verification like SEDO

A lot of Domain Name website (like GoDaddy) have sections where you can list a domain for sale, either at a fixed price or by Auction.

The question is will you get your money
I keep reading how people have sold domains here on DP and been ripped off
by either not getting their money or by by being hit with charge backs after the doamin has been transferred.

You will be ok selling the name on Sedo. Let me know the name and I may push it to auction for you.

just ask him to leave to expire or if he wants to hold on to the domain, he can register a US company (delaware or nevada) and the company can own the domain.

No one is lame enough to follow it up and report him. And after all, it's the internet, no one know anyone else.

The response is usually as quick as by the copyright police. Especially if he gets rid of it, nobody will know or say anything. If needed, he could have anyone serve as proxy.

This is kind of risky. If someone who wants the name gets to know this (which can be done through whois) then they might report it and then have the domain for themselves. I'd suggest that you transfer the name to a friend who is in the US or worst case create a fake account with US whois and push it there(this is of-course illegal).

As you know it is illegal WHY suggest it. Yet abother person with no ethics that should not be allowed to post in the legal section and should not be allowed in DP.

I was just trying to help the OP. Not that you don't know anything that's illegal.
That is why i specified its illegal, but since the OP is not trying to do any particular harm, so i posted.
Anyways i think you should mind your own business. If there was so much problem with the post, a mod would have deleted it.
