youtube embedded video issue

    I created autometed demo site that uses YouTube API (and some other APIs). It uses YouTube data related to subject of the site and displays video links and embedded videos on pages.
    Someone sends me email that his company's video is showing on site and asks for money, because his video was promoting my services. That person uploaded his video to Youtube and made it available for sharing and embedding (however, he also added that video can be used,redistributed if permission received).
    According to Youtube TOC section 5C - once you upload content to Youtube, you give Youtube rights,permission to use it with their services, unless you make video private or disable sharing.

    I can share his video same way on facebook, myspace or other socialnetworks. Will he go after these big guys for hosting his video?
    Same way I can make video of myself, write in description that content copyrighted and that I will charge $100000 for using it without my permission and post on youtube with permission to be shared. Then I go after YouTube API powered sites and will try to get money from them?
