YouTube Clone Site

    Hello guys,

    I've opened a youtube clone site, but I'm kinda confused.. Is it legal to host Music Video Clips in my site? What about YouTube, DailyMotion and the other Video Sharing site? Do they have license for hosting music video clips?

    example of music video clip: Justin Timberlake feat Madonna - 4 minute

    As with everyone else who asks this question, hosting the site itself is not illegal.

    Hosting material which violates other people's copyrights, however, IS illegal.

    So, generally speaking, you need to do 4 things:

    1. Have a good set of Terms of Service that clearly state what you're allowed to do as the site host with videos uploaded by your users. (ie: you state that you'll remove copyright-protected materials upon request of the copyright holder without consideration to the user who uploaded the info and you'll disable user accounts of people who consistently upload material that has a copyright).

    2. Do not "review" everything that's posted on your site and decide for yourself whether it's a violation. In other words, you're just a passive host.

    3. If you receive a DMCA take-down notice for a particular video, take it down.

    4. If you happen to see any content that you believe is posted by someone other than the copyright holder, take it down (again, this is a passive activity... but it blurs the line from #1 above).

    Overall, however, and like others before you, I'll tell you that what you're doing is NOT going to be too much of a passive activity on your part - and it's not going to be the passive ad-revenue generator you hope it will. You're going to get hundreds of take-down notices once copyright holders realize that you exist. You're going to have to respond to all of them or risk a "contributory infringement" suit. It's a real pain.

    So, if you have the talent to make something like a YouTube clone, I would suggest finding another business niche that actually needs filling and creating something unique and new that doesn't involve copyright violation potential. :)

    i bet in the next few years, all we see is tube site :)

    But not all of them will be as big as YouTube rite? Hopes mine can atleast reach 1/10 of what YouTube manage to get.. LOL (a big dream eh?)
