Stop bothering about who is linking to you. Unless someone is deliberately linking you from a a number of SPAMMy sites, it doesnt matter. Dont invent your own SEO principles.

It's ok if someone link to your site as long as it's related to yours.

How did you know that site was hurting your ranking. Is it the only site linking to you?

In the web anyone can place your site link at their website, it is not in your hand. And it is not hurt your ranking until you reciprocate them. So don't worry who linking you.

like websavvy said, anyone can't link to your site you can't control that but unless you link back google will not punish you.. Coz if this was the case then your competitors can easily add your links to spam sites and other unrelated sites to hurt your rankings

    You can use following tag:
    <a href="http:...sitename.com" rel="nofollow">abc </a>

In reality none of us can help who links to us and Google will not penalise you for this. The only thing Google is clear about is if you link to a site which clearly breaches it's rules or is a link farm, then Google will penalise you.
