Writing a Terms of Service?

    Hello,

    How do I go about writing a terms of service.. Is there some sort of cookie cut version? Our site will be hosting images.. Thanks

    There are probably some free resources available that are just as good, but you can buy an Web kit from Allbusiness.com in the "Forms & Agreements" section. You'll see it under "Internet and Technology Forms."

    I'm never bought this and don't know how it stands up legally, but it looks pretty good from the sample.

    With image hosting sites you need to be extremely careful. I would suggest that you go to a lawyer and have a professional terms of service drawn up for you. By hosting images you will definitely run into copyright infringement issues. If your ToS isn't legally acceptable you might run the risk of being sued or held responsible for fees payable for using the images (see the Getty Images threads).

    If you're running a images hosting site, be open to DMCA complaints (make a form?) and act accordingly. That way you would be in safe harbor under USA law, afaik.
