Last year I received the domain name backdoorintogoogle.com as part of a complicated swap for domain names with another individual. At the time I had no use for it and was going to let it expire. However I recently gained access to a series of software tools that help new sites get indexed faster by google. So I am thinking about using this domain to promote those tools. I have been told that google will not index domains with the word google in them but that is not a consideration. There are other methods of promotion besides google. My concern is whether using the domain name backdoorintogoogle.com would be a violation of the google trademark if used to promote software that assists sites with being listed in google? I would appreciate any and all comments. Thanks, gene
I thought I did until I saw sites such as this operating: googlecommunity.com, get-in-google-now.com Both are listed by Google. So I thought I might be mistaken since I am not an attorney and would seek an opinion here. If I can't use it there are other good domains available. I just hate to see something go to waste if Iown it. Even if I didn't pay anything for it. gene
I'm no lawyer, but I think it comes down to two things: First, would people get confused that the site is related to google in any way based on the look of the site or how it is promoted? Second, and most important, does google have a problem with it? The biggest fear is probably that the site might become successful after a lot of hard work, then google makes you pull the plug. I'm not sure it's worth the risk.
The bottom line is, Google is a registered mark. Any use without their permission is a violation of that. certainly, many sites exist which have blatantly flaunted the laws concerning this, and to date, Google has never bothered with it. However, that is not say that they will continue to hold that position in the future. I would imagine from google's point of view, like a lot of companies that meet this problem, it is what the name is being used for. If it is being used in a positive manner and in no way creates any difficulties or issues for google, chances are they would ignore it. However, you could never take that as any sort of guarantee. If the name makes you money in any way, ride with it for as long as you can, just bear in mind that one day the bubble could burst with it.
I think doggie-in-the-backdoor-of-google.com might be a bit a risk But seriously. Anything that contains anyones trademarked name is probably a sketchy at best. I usually go by this: If you have to ask if it is wrong, it probably is.
