Would this be a TOS violation?

    i have seen a couple of sites that have done the same thing, and i click on it not really knowing,it is a violation of AdSense TOS, as the link there are referring to is below the adsense, and this is misleading users

    I think it is a very clear violation of TOS, since it says "click on the link below", and below is the adsense box, and only after it is the actual link.
