Won A Name At Auction But Now Have Issues

    Hi All

I recently won a domain name at auction with SEDO. The guy who currently own it is not replying to their emails.

What happens here? I thought by entering into an auction its the law that they have to sell the name if it reaches the reserve which it has.

Just wondering if any one has an experience of this.

    Thanks

    James

With out sounding sarcastic I have done that. I am asking here to get a general response of how the law works with auctions and situations like this.

SEDO probably wont be bothered with the hassle and tell me that I can have my money back. BUT! I have spent a lot of time working on a project and need the name I have won.

Contact your lawyer. A forum is no real substitute for this kind of legal advice.

Alternatively, go to NamePros.com and search the threads in the Legal section there, as no doubt, this kind of thing has occurred before, bear in mind though that you will only get a general synopsis of the law as it stands in circumstances such as this, whilst your lawyer/solicitor will be able to give you much more specific advice directly pertinent to your particular case and grievance.

Chances are good that the best you will do is your money back unless you are willing to waste a lot more time and money on this.

The good news may be that your recent is that recent. Give the seller time to respond. This is a busy time of year for most people. How long has it been?

They might just be still on vacation for the holidays, where do they live?... Here in Australia most businesses and people don't return to work from the beach etc until at least the 7th of January and many later in January.

Don't know for sure, but some of these sales places allow the seller to reject any and all bids before, during and after the auction.

And they don't have to tell you anything other than "no deal".

Should that be the case, you can scream lawyer all you want. Only thing it will get you is a lighter wallet.

Check that out in the TOS or Users Agreement section.
