this is from the Microsoft website. it is a list of their registered trademarks.

Windows-7 does not appear on the list.

    http://www.microsoft.com/library/toolbar/3.0/trademarks/en-us.mspx

I also note that as of today there is no TM or similar mark next to the words Windows 7 on the Microsoft page whilst there is a TM symbol next to the words Microsoft.

Having read the related documents on the Microsoft site and other related material, each of the above domain names a, with perhaps the exception of the WINDOWS-7-UPGRADES.INFO domain name, all clearly related to and convey the impression that they are about the Windows 7 product, from a public discussion point of view.
Their names do not imply or suggest anything official, but suggest they are looking at and discussing the product, which we are all entitled to do.

The fact that these domain names are also in the .info domain also suggest that are information about the product, not the product.

If I get an email from the forum owners asking for these domains to be taken down from sale, I am happy to oblige but a simple Google search does show there are many similar named domains out there.

You can't ride the goodwill of an established company by registering a domain name with their mark in it, it's trademark infringement.

"Windows" is a registered trademark of Microsoft. That means windows 7, windows 8, windows 9, or any other operating system they have is protected. You can't add words or numbers to a domain name and get around infringement.

I have over 15 years of experience in trademarks - they are all infringement and the TLD doesn't make a bit of difference (the link I provide also shows they have sued .info holders).

Those domains cannot be used for anything related to Microsoft, and operating system, or anything related - it's trademark infringement and just owning those domains could be cause for a cybersquatting case. A disclaimer on the site isn't going to protect you.

Microsoft is under no obligation to notify or warn you before filing a lawsuit. The fact that others have infringing domains means nothing, and isn't a legal defense.

    thank you for your information.
I dont necessarily agree with all you have written as I believe the area is a lot more grey than you portray.

However, I have decided to write to Microsoft on this issue as they are the experts in this field of whether or not they believe I am infringing on their trademark.

Until I have heard back from them, I think its only reasonable to withdraw these windows domains from sale.
