Will This Keyword Domain Get You Into A Lawsuit??

    Hello All!

    I wanted to check if reselling a Trademark domain will get you sued?

    For example:

    "facebook".

    Will facebook1huedbg.com get you into trouble just because it has the "facebook" keyword in the domain.

    If yes, then how come there are so many domains of the same keyword being sold here :

    Need some expert advice on this. Newbies plz do not comment here if you do not have any idea about this.


    Any and every expert opinion would be very much appreciated.

    Yes, it potentially would. Don't risk it with TM domains.

    In some cases it might be legit.
    For example say you buy apple.com although it is registered ecc. if you talk about apples you can't get sued.
    But with facebook and stuff like that like that although ppl do it eg. facebookasciiart.com I would personally avoid these situations if possible

    Do you think if I resell it just to get rid of it or park it for money, will it still get me into trouble?

    I think it depends if You act in "bad" or "good" faith. Maybe somebody noticed "Facebook of sex" ads on some sites :D it was only question of time when will FaceBook notice. They probably noticed and it was rebranded, but now i can see Facebook of Sex ads again so i wouldn´t be afraid to register for instance facebookapps.info and buid there a site about facebook applications.

    hmmm.. i wish I have a copy of the US law on trademarks. In many countries like mine, if TM is a special law, good faith or bad faith is immaterial. Intent is immaterial. A special law is a "Malum Prohibitum". Mere violation is punishable.."Ignorance of the law excuses no one"...

    Next time stay away from TM issues...

    The person you essentially transfer the risk to might come after you if they're
    that determined. And Facebook can still use that parking page as proof of you
    trying to ride on their trademark without their permission.

    I am under the impression that if you use a domain to profit from a trademark or something similar ie. using applesale.com to sell apple products or linking apple ads you could be in a world of hurt. I was under the impression that if it content/ads weren't directly related you would be fine

    One problem here is dealing with arguably famous marks like Facebook. Even if
    you change the ads to reflect something else, will that stop some people from
    thinking your domain name's associated with Facebook itself?

    Well I had 1st parked it with Godaddy then got rid of the parked page and now all it says is "This website is temporarily unavailable, please try again later. "

    I hope that would not get me into trouble. The domain is pretty much lying useless in my Godaddy account.
