I just received an email from Moola that invites us to use their site for google search. Basically the page has nothing but a Adsense search (Google custom search?) and a link saying "Search and spin for up to $36,000 daily." Does it violate the TOS?
Even though they are stating the above, they are still drawing unnatural attention to "clicking links". And the fact that it is all incentive based. Sounds like a dark shade of grey. Hopefully they will have contacted adsense to clear it first.
It's actually a newsletter for their members. But if you call it SPAM then they definitely violate the TOS.
I'm not sure its a totally spam email, i assume everyone who got it was a registered member of the site who would get e-mails anyway. Edit: Too late!
TOS say that you are now allowed to encourage visitors to click links, no matter how you encourage them.
It looks like the co-op search engine facility that google provide. They are using it to create a 'raffle'. - They are making money out of their adwords campaign and giving some back to their users. This is not against the TOC, I feel.
You are 'now'? or you are 'not'? I think a lot of webmasters will follow the same trick if Google changes their TOS So how about this: send out newsletters to invite people to bookmark the page with incentive (that page contains a google search), but say nothing regarding the reward of using google search. Does it violate TOS this time?
No it isn't. That one typo completely changes the meaning of that sentence into something that simply isn't true. Encouraging users to click on your ads, either explicitly or implicitly, is against the ToS. Offering incentives to use the search feature is walking a very fine line.
