I was hired as a freelancer by a Advertising agency to build a website. The client was unhappy with relations with the advertising agency and hence sacked them. Months later the client contacted my directly and want me to work on the website, but the Advertising Agency is threatening legal action on me and the client. I haven't done any work on it yet as I'm not sure on my legal standings. Does anyone know what they are. It has been over 6 months and the client has the rights to all the source files... which I initially created.
Did you have a non-compete that you signed with the advertising agency? If so, they have every right to sue you if you go to work directly for one of their clients. I'm guessing from your email that is the case, but without seeing the agreement, I can't tell you what your legal standing is... I never signed any agreement..... in any case, as a freelancer when would the client be legally allowed to ask me for a quote on a different job? For example. If company X was hired by company Y to produce something for company Z, at what point would company Z be allowed to contact company X?
