If you place the adsense code on any site that does not meet the adsense terms and conditions then if Google check the site (or it gets reported), then either adserving will be disabled or the adsense account banned. If your site has been repeatedly rejected, then it dos not meet the adsense terms and conditions.
I do wonder if they review a site if automated checks show a change in ownership (via whois and applicant details) and a significant change in content. As the internet matures domains change hands, or get dropped and reregistered and it's unrealistic to taint a domain permanently. The OP, however, hasn't mentioned that he's made efforts to upgrade his site to comply with adsense requirements (which are sensible, IMO)
you could register another site, get approved, and then add this as a secondary site... but as Agent000 says, it may get banned quickly if they notice
