We have a website business called demo. in. We are a company from last 15 years. Now we want to take demo. com But the problem is that someone registered demo .com . Is there any way to complaint ? He is telling the price 250$?
You mean that you want to buy demo .com? Or "demo" is not your domain's real word? Anyway, the fact that you own demo. in does not mean that you could own demo. com. The owner of demo. com does not break a law by having the same name with your domain. Dot com is universal, but dot in is not. If someone in India has a similar .in domain with your business, you could file a complaint in this case.
demo is not real word. Just as an example. The demo.com does not have any business. If i go to demo.com it shows this domain is available to buy start bidding.
So buy it from him at his offering price or offer him some money for it and negotiate. Buying it is your only option.
You have not described anything that is a trademark violation. What is it you think they are doing that is violating your trademark?
You are not making a whole lot of sense on what the price is or was. If he jacked the price way up on you I can only assume you told him how you own the .in version and really really want the .com. Anyway, it is a free market and people can demand unreasonable prices for domains if they want.
lol! Great observation, browntwn! There is no trademark violation unless your business is a global business like ebay or facebook. Someone who tries to sell his domains that have these names would be in trouble. Also, you may want to check on WhoIs when "demo .com" was first registered.
Failed in trying to post comment on this thread for 5 times but unfortunately, I only got error report of "Server did not respond in time when fetching https:www (offline or too slow?)."
Let's see below the whois information: Domain Name: DEMO.COM Creation Date: 26-mar-1998 So, I personally don't think you would win the case even if you report to UDRP/WIPO.
I would tell you honestly about it. The owner increase the price because you may didn't do these step: First, you need to build good relationship with the owner. Make sure to find explore social network and numerous blogs linked with the owner. Tedious job but it will save you headache later on. Explain nicely about your vision and what you have done to make this earth as better place for everyone. You shouldn't lie about what you wanna do and what you were trying to get with your business/company. Tell the owner if you think the domain could help your business. If you sell souvenir, try to send one to the owner. Last, offer reasonable amount of money to owner and tell him if you going to build and handle it with great care. There are lots of things you should avoid: Telling them if you already own same domain with another extension. Why: Because it may ruin your effort. If the owner ask about it, then you can safely tell him the story. Told the owner if you already has the registered trademark for that domain. Why: Because your trademark maybe effective only in local areas/specified country. Registered business and registered domain are two different things. Registered business may got registered domain only if they choose to get it. Accuse a someone violating trademark. Never, ever did this. You'll not only lose the domain but also set to the jail. Accusing someone violating a trademark is not good idea. Especially if you did this by using email or other printable materials. If the owner want to bring it to the court, it could lead to 'business hurricane' which will affect your legal business. If everything fail, you may wish to ask someone or professional to get the domain for you. It would need lots amounts of money but there is big chance to get the domain. I see there is a representative of ICANN registrar in this thread. In case you didn't notice it, Helen from IISP (comment above me) is representative from well respected registrar. I was reading your old comment stating about MarkMonitor.com It is a service which working with great company to protect their brand. Last time I heard Google were using their services. An excellent company to protect business in internet. It actively scan any website for copyright infringement. Definitely really hard to win against it. Btw, I do feel the same. Been waiting the forum to load for more than a minute but no progress at all. few minutes ago it was quite slow but most of the times it really fast. I'm lucky my comment didn't lost. I know OP only use demo.com as an example but make sure to fully recognize who own the domain to make sure it is obtainable or not. Edit: Correcting few grammatical errors.
Usually if you are literally "dying" to get such domain name, you will find the actual owner increasing the price no matter how nicely you treat him.
