Seems like they say you have to honor the price om the TOS, yet they do not enforce it. That is my beef. FTR the price they are offering is still out there. Still can't buy it at that price. Wish I could escalate to another level.
Thats part true, but because you are forgetting unilateral contracts, its mostly wrong in this instance. You are completely forgetting unilateral contracts (uk case law)... anyway In unilateral contracts the offeror waives the right to acceptance, providing the advert shows that they intended to be legally bound. What does the advert actually say. If its conclusive enough and uses enough promissory language you can pretty much bet if someone really wanted it at that price, they would have to yield. Theres cases dating back over 150 years to back this up also.
