I have a question here that what to do if content copied from mine website because some one has copied mine content aim having copy scape logo too on mine website then also they have done copied mine content can i take any legal action ?
Actuallly you can't prohibit someone from copying your content as far as they can access you site... easily
This in unavoidable since your content is online and one can easily copy it. You can email the site owner who copied your content and talk him out to take down the copied content?
The only mature thing would be to email the website administrator and kindly ask him to take down said content, and if s/he refuses to do so you can either remove and rewrite your content or leave it as is.
Actually you have a few options. Firstly gather as much contact information as you can (use whois to start) and proof that it is your content (wayback machine is often helpful here) Email the site owner at all the email addresses you can find informing him/her that they have your copyrighted content on their site without your permission and request that they remove it. (give them a time frame i.e 7 days) Give full details of what the content is and where it can be found on their site. Be nice but firm and let them know that if they fail to do so you will issuing a formal DMCA notice and will be contacting their host, site sponsors, link partners, search engines, domain registrar etc to let them know they are dealing with stolen content. This usually works, but if it doesn't you still have an option, and that is actually filing the notice with the thief's host and the big search engines Google, Yahoo, and MSN. Google "DMCA notice" there are tons of sites with info - but make sure you fill it out correctly. If it is correct, their host will take down the content (and search engines remove their listings) but they do have the right to file a counter notice (Never had it happen to me - but then I keep tons of proof my work is mine and makes sure the thief knows it) and should they do so the content will be put up again. Your last option - if they are gaining financially by your content - would be to take them to court. Sites like copyscape.com and plagiarismchecker.com will assist you in finding out if your content has been stolen. Good luck
totally agree ... may be u can use scripts that prevent others from copying ur content or prevent right click use however visitor might not feel comfortable ..
Contact the author first else Just report a DMCA violation to Google But don't worry Google will automatically punish them
It is not as simple as that, visitors have only access to your site, read the legal issue sub-forum and you will realise how simple/hard it can get sometimes This has happened to my homepage recently, someone just copied and pasted it into a major article directory, read the full thread here Article Site violating my copyright! it should enlighten you to take the course of action
Thanks for such a nice suggestions friends from the above information we cannot do any thing legal action i think so just we can warn some one if mine content is copied hope that i will take straight action if it happen again.
you might not want to initiate legal action due to the costs, but as I explained in my reply there IS a way to get them to remove your content - so long as you can prove that it is yours and you posted first. I'd be contacting their host with a take down notice if it was my content. A good host will not protect a bad client, its too risky for them and the have to act on a properly written take down notice. It is never ok to have your content stolen - and The Digital Millennium Copyright Act is there to protect you - so use it. Like I said before there are lots of sites that will give you full instructions - google "copyright violations" "how to issue a dmca notice" etc for more detailed advice
