Hello, My uncle owns a Interior, exterior designing company and I am designing a site for them but the problem is that the color of logo is Green and that doesn't match the rest theme of the template. If I change the color of logo according to the theme, will this affect the legality or it could create some trouble for the company? Thank you in advance. Site URL: www.qi.com.pk The actual color of the logo is GREEN ~F-GD
I can't see that there would be any problem with regards to legality. The company (your uncle) owns the logo, so they can adjust it to meet their requirements. As long as they don't misrepresent themselves or use trademarked elements in the logo, the color will definitely not make a difference. The first logo looks excellent BTW. You might just want to have it in a uniform color without the "white line" in the middle to make it easier to read.
Thats what I thought Thank you so much for your reply. I will surely be doing something with the text in the logo.
/EDIT Sorry, when I saw the phone number on the page I thought India. When I looked at it again I saw the city and realized Pakistan. I suppose the URL should have tipped me off as well. I will update this with Pakistan specific info when their IPO site becomes available (it seems to be down right now). EDIT\ A couple questions: Is the logo registered as a trademark? If the answer is no then it makes no difference. If the answer is yes then you must look at the trademark application. In India, if the trademark application lists the colors then only the mark with the color combination on the application gets the extra protection. If the colors were not listed then the colors have no bearing on the trade mark. Check the trademark rules for India (search for colour). Who created the trademark? I do not know the rules about this in India, but in the US this can make a huge difference. The examples below reflect US law. Example A) A full-time employee of the company created the logo. The copyright for the logo is owned by the company so the company can do anything they want with it. Example B) A freelancer makes the logo for the company. In the contract, the designer agrees to give all copyrights to the company. The company then owns the copyright for the logo and can do anything they want with it. Example C) A freelancer makes the logo but there is no stipulation of copyright in the contract. The freelancer still owns the copyright of the image. Even though specific usage of the logo may have been stipulated in the contract (to be used on website, promotional material, and letter head...), the right to make derivative works still rests with the freelancer. If the company wants to change the color, they must get permission from the freelancer or pay him to do it.
I like the golden logo the best. I think the shading down the center of the letters could be darkened rather than lightened.
