People I know always tell me they dont know how to work torrents to find music or movies to download and I was thinking of setting up a simple to use site for them to use. If the site had links to download sites like megaupload and rapidshare for downloads, or linked to torrent sites like piratebay and isohunt, but didnt actually host any files, what are some hosts that I could use? Thanks
Probably none in the US. You're going to have to get some sort of off-shore hosting most likely. Well...thinking about it again, if you're only having links to rapidshare or such, there might be some that would allow it, but you're really going to have to search. I still say offshore would be the way to go.
I'm glad you were able to post your affiliate link again, toocoolamit. *sigh* Hostgator absolutely DOES NOT ALLOW links to illegal material. You can go here for further info: http://forums.hostgator.com/we-allowed-link-pirated-content-t32927.html?t=32927 As I said, there are very few hosts in the US that are going to allow it.
You may have to go with offshore hosting. Most of hosting based in United States do always state prohibited against being hosted for mp3 files or any file storage only purpose. There are some offshore in Netherlands and Sweden that may suit you.
What is your budget and which configuration do you need? Currently have servers available in the Netherlands
There are likely many hosts outside of the US which will accommodate your needs. "Offshore" or not though, you're best bet is to contact them and ask them if this is allowed before purchase, just to make sure, also be sure to read through the TOS.
You can link to any site you wish from any server period. All you need is a disclosure similar to this. Watch-Series does not stream videos or host content of any kind, the videos you watch are hosted and shown from sites such as YouTube, Tudou & Megavideo. Any videos shown on 3rd party websites have passed their own stringent internal vetting procedures and as such are assumed as fully authorized for publication by the content owners.Watch-Series is not responsible for content of external internet sites. Watch-Series is not responsible for the availability of such third party web sites. The content of such third party web sites is beyond our control. We neither endorse, make any representations nor accept any liability (whether direct or indirect) for such third party web sites or their content, products or services offered at those web sites, or by their sponsoring companies. I use to link to magaupload from my yahoo server and had no problems. If it was illegal to link to such sights Google would be in big trouble because they link to them every day. Servers state that hosting such files is prohibited but you find nothing about linking. Canada is not a American state yet so they have different laws (Net Nautrlity). A candian server is as good as a american as far as search engines are concerned. As far as witch server to use this depends on what your gonna do. Text links use no space at all and you could use one of the free servers found on my sight or Google free servers. A lot of pictures takes more bandwidth so you may need a cheap server if you wanna use a ready made blog with pictures. Your needs aren't really that great. Pretty basic stuff really. I suggest You start with a free server and focus on content and your links until you can get a good name for your self. Use one that offers cpanel and you can upgrade or move your sight when needed.
Hostgator doesn't restrict links. If you can find this in their terms you are at the wrong site. Dp is a better forum so please don't use hg forum as a resource (especially when a representative of hg did not comment)
Wait...use DP, but not Hostgator's own forum for a resource?!?! That's absolutely silly. Furthermore, chaty1, it IS IN THEIR TERMS OF SERVICE. That covers part of it. That covers the rest, in case you had any doubt. I took the liberty of bolding some items for you. Have you actually read their TOS? Have a great day!
WRONG. A disclaimer does not allow you to do something that is illegal. That disclaimer is completely worthless and will do nothing to prevent you from being sued. Linking to copyright infringing material is contributory infringement in the US as well as various other countries.
Okay it's their but you missed http://www.hostgator.com/copyright.shtml. It is always the responsibility of the copyright holder to protect his copyright. Only the copyright holder can complain and they recommend they get a lawyer. First they need to shut down the site that is hosting the content. They tried to shut down youtube and ended up setting a president protecting youtube. Do a search for watch online in google. The results are only growing. They have to stop Google from linking to these sites before they can stop any one else. As long as the download site is user uploaded, than the liability lies solely with the user's. As far as the disclaimer goes. It is not your responsibility to check if the site has a license for every single piece of content before you link to it. A few words from google http://www.google.com/dmca.html Court case affecting this matter source is a government regulated news broadcastor http://www.cbc.ca/arts/media/story/2010/12/03/viacom-youtube-appeal-court-decision.html the law protecting internet sights Digital Millennium Copyright Act Seriously their are millions and millions of such sights hosted in the united states. You need to dig deep but no one is stopping you. About 74,000,000 results http://www.google.ca/search?q=rapid...s=org.mozilla:en-US:official&client=firefox-a
If a DMCA is filed, hostgator is going to remove the content or terminate your hosting. The copyright holder can still sue the website owner. Google has spent over a hundred million dollars in legal fees in it's lawsuit with viacom, and it is still going through the court appeal. Youtube is not the same as a movie site. You do not have the legal funds that would be necessary to mount even a basic legal defense. "It is not your responsibility to check if the site has a license for every single piece of content before you link to it." Wrong. It is absolutely the site owners responsibility for content displayed on their site. If the site owner knows, or should have known, that content they are displaying or linking to is infringing, they are legally liable. A site set up specially to link to movies or tv shows is not going to offer the site owner a legal defense.
Host gator will remove repeat offenders if they don't remove the link. Lots of sites hosted on host gator doing just this. The point is they won and until they lose all web sites are protected under the same laws. How many cases have you seen since they won and please feel free to supply your sources, as I have done. "Wrong. It is absolutely the site owners responsibility for content displayed on their site. If the site owner knows, or should have known, that content they are displaying or linking to is infringing, they are legally liable. A site set up specially to link to movies or tv shows is not going to offer the site owner a legal defense." Please provide the court case or legal source to back this up. I am not aware of any one being charged ever for linking to any site for free. If your worried about legal defense post the links at google.com. They have lots of money and it's free. You can go on forever but the simple truth is no one is stopping you or at the very most they are asking you to remove a single link, and at this time it is all you are required to do. I am aware of sites that operate in the united states but not aware of any linking sites that have been charged or sued. I am only aware of user's that have been charged for uploading.
LOL, Because "you are not aware" - it's called contributory infringement. Plaintiff Intellectual Reserve (IR) vs Utah Lighthouse Ministry (ULM) Universal City Studios, Inc. v. Reimerdes Comcast vs. Hightech Electronics Inc
Plaintiff Intellectual Reserve (IR) vs Utah Lighthouse Ministry (ULM) Is a preliminary injunction. Not the same as winning the case. They had to remove three links. Until the case was heard. Nothing on the actual case. Seems like removing the links worked. Also state law not federal as are all of these cases. lol stay out of Utah Universal City Studios, Inc. v. Reimerdes Again the judge ordered they stop and the plaintiff had to pay his own legal fees. No damages rewarded. The main point here is they developed and downloaded the program. Not charged with linking to it. Lmao not evan closely related to linking to torrents, but okay lets deal with it. The movie and music industries dropped the security programs because they finally realized that they punished the paying customer not the free uploads. Not matter what they do you can always record from device to devices threw the air. Comcast vs. Hightech Electronics Inc LOl your tired go to bed. Case is related to a referral program. The guy got payed when some bought a satelight cheat box. It was found that was essentially selling the box's. Okay I agree, he was selling cheat box's. So whats your point does the guy link to copyrighted material?
Okay I am tired of this. Do a google search and it will become self evident that no one will stop you from building such a site. The reason I got out of it is simple. Watch online produces 110 000 000 results and most of the user's are cheap. that's why they are using the service. I was getting 5000 hits a day and was making pennies. I was also concerned that the current laws may change. If they do change than you would have to act fast to shut down the server or possibly be penalized.
Chaty1, I don't know what world you are living in, but it is illegal, plain and simple here in the US. Hosting such material will result in your host terminating you if they find out, and could absolutely result in legal action. Run a site linking to illegal material at your own risk.
You are a moron. Those cases deal with contributory infringement. "with knowledge of the infringing activity, induces, causes or materially contributes to the infringing conduct of another." The Utah case was heard in Federal Court. "Utah federal district court judge Tena Campbell ruled that linking to other Web sites which the linking party knows display infringing content - even though there is no affiliation between the linking party's site and the infringing sites - probably subjects the linking party to liability for contributory infringement. The court's decision has raised concerns from those who believe it might force a change in what makes the Web useful, namely the ability to link at will to other Web sites." http://www.wilmerhale.com/publications/whPubsDetail.aspx?publication=1722 "Contributory copyright infringement is the act of linking to or transmitting information on how to access copyrighted material illegally from another source. For example posting a link to an illegitimate download of a song would be contributory copyright infringement. You might not be hosting the song on your server, and you might not have been the one that ripped it and put it online but you are still responsible for giving access to it." http://www.elawfacts.com/contributory-copyright-infringment-and-illegal-linking/
Utah federal district court judge Tena Campbell ruled that linking to other Web sites which the linking party knows display infringing content as I stated http://legal-dictionary.thefreedictionary.com/Preliminary+Injunction The case never went to court. It's kind of like saying that a person is guilty because they didn't get bail. Just a step in the legal argument. The site in question now just simply links to other sites that link to the online book. No word on those sites going to court. still responsible for giving access to it." The up loader is liable. At the very most you would have to make it a user added link page. As stated before the current result of linking to copy righted material is you will be asked to remove the link. The case you are talking about happened after the site refused to remove the link. As far as www.elawfacts.com/contributor...legal-linking/ Just a blogger with no source links. It is true almost any one can sue you in the states but they have to pay the court cost when they lose. I could be wrong, I am simply asking for the court case that found a defendant guilty for linking to a music turrent or linking to a youtube video
