Hello, Well, to get into it, my dad owns his own business which is registered in the state of Arizona as "Blue Surf Pools". He wants me to setup his website for him using the domain bluesurfpools.com, however it is already registered. He was aware of this a while ago, which a business in Texas used it, but now it's just on the backburner. He asked me to contact the owner regarding it, but seeing as I've never done that before, I'm wondering what should I include, and what should I say? For example, should I include that my dad (I may write as I am him), owns the trademark within Arizona, or will that make me sound too "desperate" to have it, making the owner think he will be able to coax me for more money, etc.? I'm just curious as to how I should approach this situation. Thanks, Andrew
If you own trademark you could sue. If it is just registered business name in your state you can not. You could always get info or net domain name.
Yeah, it's just in this state, so I know I couldn't sue. I'm just looking to buy the domain, but I'm not sure how to do it in the way which doesn't make me sound desperate to get it.
try sending an email to and see if they respond. do a whois request to see any contact info and see if you contact them. odds are they'll want $$ for the domain if they are sitting on it.
bluesurfpool.com is currently available. I think for the meantime why not register this, it does not cost you more than a few bucks to register and even if you are not using it, it prevents anyone from pretending to be you. Then see if you can pursue the other person.

Andrew, let me help you to conclude the situation 1. Register bluesurfpool.com OR bluesurfpools.net 2. Contact the owner - but before you do this, try to look up from any source you can (I gathered that from the whois you get this keywordmarketinginc.com) about the company/person who owns this URL without letting them knowing it. Study your enemy first before you go into any negotiation. Because, if it is a big company, then I think you're better off buying the .net because I'm very sure they're not letting it go especially if it is an established company. But if it is a small fry owner then you can probably coax the guy into selling the ownership. Just a tip on negotiation: Make sure you know your other party very well before you enter any negotiation, be prepared. Make up in your mind that you can achieve a win-win situation even though it might not be of the same value to both parties. Show to them that you are serious about the deal but not to the point of desperation and do please... be polite no matter what the situation is.
I will register bluesurfpool.com, but the only problem is, that his company name is pools, so they might be confused (they as in potential customers). I'm aware of his contact information, and I also am aware that I will have to pay for it, I was just asking for information on how to approach him to buy it, without making it sound like I'll pay any price.
