There's a website owner who also moderates the forum of his site and he calls me a thief because one of my customers asked for a refund 6 months after purchasing my software and my refund policy if 60 days and I refused the refund. This customer posted on that website's forum about me not giving a refund (without mentioning he was months past my refund policy) and now the owner of that website/forum is calling me a thief. For the record I have always without exception granted refunds when requested during my 60 day refund policy and also often even months after, but this particular customer was posting bad things about me everywhere so I refused him the refund. A google search for my name finds his website and post as the 3rd result. Is there anything I can do to get him to remove that as I'm worried it may harm me in getting a job. Thank you
You can create an account on that forum and explain the truth. Also contact the Admin your Genuine concern. Hope he will surely help you.
He is a real a-hole, if I post explaining it he will probably delete it. I even threatened to take legal action hoping he would remove it and he just replied saying he notified his lawyers and will be waiting for the papers.
Never threaten legal action unless you intend to follow through. Now you've made a rod for your own back and your position is considerably weakened. If he isn't going to remove it then your only hope of getting anything done now is to do what you say. Get an attorney to write to him. You can be sure he hasn't informed his lawyers of anything - why would he, they would just tell him to wait until something more official turned up?
I would have to side with "mob" on this one. Your best bet would be to speak with someone in charge (higher up preferably, or the owner) and explain what has happened. If your client was in fact past the 60 refund policy then you have nothing to fear legally yourself. But also as "RonBrown" stated, you shouldn't start throwing around the words "lawyer and suing" unless you really intend to or you may find yourself in some really hot water.
call your local state bar lawyer referral line and see if you have a case. don't pay anything to find out though.
