    Hi All

I run a small web hosting company, recently not directly came across a scary
situation another hosting company I know had a hacker store files on their server unknown to them. Now they face a court case and also in trouble with their server company.

How do you protect your company from this situation, we have Terms of service on our site but the company I mention also did.

    Any Advice would be Great

Well, this is exactly what the DMCA covers. Hosting providers aren't liable for the actions of their customers so long as they meet certain criteria.

If they don't scan every file stored... and they remove files that infringe or are harmful when asked... and they're diligent about watching for nefarious behavior... then they'll be ok.

Essentially, a host is just a host. Unless they do "more" that makes them more than a host.
