all most all file hosts have similar TOS, but from my experience all of them, except megaupload, pay even if the files are removed due to copyright violation. they just delete the files when complaints are received and will PAY for downloads till they are deleted. from ur replies, its obvious that u dont have money to pay for users and its almost clear u r the only running that site sorry to say this, but i wud definitely stay away from such a site
