Its a dodgy subject. There is nothing saying that its illegal... but people have been taken to court for it. So some data centres won't allow as they have a risk, others don't mind.
well don't be surprised if it soon becomes illegal. here in Spain it recently became illegal to link to any illegal content and France is wanting to approve a similar law in the upcoming weeks.
Illegal if the web hosting is done in the US. Has the potential for tons of virus's/malware so why do it?
It's not illegal to link to anything. The legality is based on whether it is legal to host the content.
linking isn't illegal so if you wrap the warez link in code to say rapidshare you can't get in trouble
As others have said most data centers in US don't allow it's too big of a risk. The best thing to do is get hosting in Holland or Malaysia people I know have never had problems linking in those countries.
have someone in RO own the domain and hosting and you won't have any problem; in US you will get into trouble.
Google will not do nothing about links, as far as they don't host the file. Also companies as Rapidshare use a very naive (but effective trick) to host wareza: as they DO NOT MAKE LINKS PUBLIC and they "don't know" what the links have, they have no responsability. Let me tell you that, for developers, Rapidshare is good. Because they are very fast to delete a file if you report it to abuse. Some time ago, when files was hosted on Russian sites, there where almost impossible to report abuse, nobody cares. But RS, Easy-Share, MegaUpload, etc. are very fast on deleting files if reported.
Mmm... i can find many rapidshare links in Google... that means that Google owners will get in jail????
