Vista .com domain names

    Hi Forum,

    I like to give appraisals but thought i would get one off you guys for a change. None of these domains have trademark issues my company works very closely with Microsoft UK and so i know there is not an issue.

    So please tell me what you think, a few of these are getting very good traffic so i am hopeful

    vistascr.com- PR 2 Domain
    vistasavers.com - PR 2 Domain
    vistanetops.com - PR 2 Domain
    focusonvista.com - PR 2 Domain
    vistaathome.com - PR 2 Domain
    vistaissues.com - PR 2 Domain
    tourvista.com - PR 2 Domain
    vistapowertoys.com - PR 2 Domain
    vistatechnet.com - PR 2 Domain

    Don't you hate when any domain you register that actually can be used for anything gets a comment like -
    TM issue reg fee???

    I can't stand that...

    I made sure via colleges before registering these last year that i would get no TM issues. Thanks for your post.

    There probably aren't any trademark issues with most or all of those names - as long as you don't put anything content on the sites that has anything to do with Microsoft or a related product. Much of the time, its the content of a site that determines if it is trademark infringement. It you are attempting to ride the goodwill of another company, that's infringement.

    Developing Vistasavers into a site for people who want to protect beautiful park views wouldn't likely have any problems from Microsoft. Develop the same domain into a site with screen savers for computer operating systems, and you would almost certainly be hearing from their legal department.

    FYI, there is no one that can tell you a domain won't have any trademark issues unless you have a written licensing agreement to use a name from a trademark holder.

    You can have someone do a search for a Federally Registered Trademark, but a trademark that hasn't been registered can be just as solid as a registered one. The first to use a name, and continue to use a name, has rights to the name for that particular usage. You don't need to file for a Registered trademark to protect a name. A filing does establish the date you first started using it - and makes it possible to collect treble legal fees in infringement cases.
