James Pacenza, 58, of Montgomery, says he visits chat rooms to treat traumatic stress incurred in 1969 when he saw his best friend killed during an Army patrol in Vietnam. In papers filed in federal court in White Plains, Pacenza said the stress caused him to become "a sex addict, and with the development of the Internet, an Internet addict." He claimed protection under the American with Disabilities Act. http://edition.cnn.com/2007/LAW/02/18/chat.room.lawsuit.ap/index.html His lawyer, Michael Diederich, says Pacenza never visited pornographic sites at work, violated no written IBM rule and did not surf the Internet any more or any differently than other employees. He also says age discrimination contributed to IBM's actions. Pacenza, 55 at the time, had been with the company for 19 years and says he could have retired in a year. Sueing IBM for 5 Million USD on the grounds he deserves treatment and sympathy rather than dismissal Sounds like a Lawyers dream for 'raking in the fees' Comments :-
thats the main problem with our legal system....the lawyer will get 60% of whatever micheal gets, if he wins....what a crock.
Sounds like a good argument to me. I never wanted to embezzle millions of dollars before I worked at a bank!
I've just started watching the first series of Boston Legal and can imagine an Alan Shore (James Spader) style lawyer winning a case like this. Great to watch, but it's worrying that people will sue for such daft things these days.
don't forget about John Edwards...how do you think he got rich...we call them ambulance chasers down here in the south...they get 60% or more of the cases they win, which are worth millions...
