Video game footage permitted in YouTube Partnership Program?

YouTube have invited me to join their Partnership Program based on a large number of hits I'm getting for a specific video.

Funny thing is, this video contains footage of me playing video games, and demonstrating a handheld operating system - which I thought would be against their strict "no copyrighted content" rules.

    WTF?

Anyone using the YouTube Partnership Program have any advice?
Do I join, and risk having my video deleted?
Or do I do nothing, and keep the traffic that's being generated by the non monetized clip?

It is an automated message. It will allow you to enable it but once someone looks at your videos they will terminate alpartnership agreements. I had about 10 video with revenue share enabled and they stopped all of them.l
