Hi, I am planning on paying people to make videos and then use those videos to make a larger DVD movie type thing. I was wondering what legal issues surround this. I know i will have to give a consent form. But how do i make the videos they send me, MY property? what other legal issues can I run into?
It is going to depend on where you live and where the people you hire live as laws vary. You will need a model release and commercial rights release but you should really consult with an attorney and have them draft something up to protect you down the road.
I suggest you have a lawyer draw up a contract, it's best to get yourself protected then risk having your stuff floating around everywhere.
i could careless if the final video is distributed but my main concern is not the get into trouble witht he original video makers. What kind of consent form should i create? I dont want to hire a lawyer becuase A. I have no money, and B. the video i am planning on making is going to be VERY VERY LOW budget so its not really worth it. However, I do know that people will be interested in buying it.
Just have them sign a contract that (1) identifies the videographers as an independent contractor, (2) releases all rights to the production and (3) holds him/her legally responsible for breaching or violating the rights of others (people, companies, etc.). There are probably some contracts online you could use as a model for your own if you dig deep enough. And you'll be the wiser for being extremely detailed in this contract!
