Hello, Last week I sold a load of domains on eBay in bulk. ONLY the domains were sold and no content. I have just been informed that the following domains are displaying our own business contact information and even the screenshots to our clients websites. These domains are also being used to send out massive spam and I am getting bombarded with very angry business owners who are contacting me about it as it is our own contact details that are displayed. I have contacted the person that purchased the domains and he informed me that he has sold them to someone else as he was just acting as a broker. I have contacted the new owner but no responce has been received. I would suggest that you write a email that sounds like legal notice that if you do not stop within X number of hours we will take further legal action including but not limited to contacting icann and other proper legal authorities for spamming. I would email the hosting provider right now and explain the situation to them including copyright violations and request them to take those sites down. Then i would contact the registrar of domain to change the contact information and let them know proper situation. These are just my suggesstions but dont forget to email their host they will take care of it. Hopefuly it will get better.
definately shady techniques. The reason they do this is because those domains have probably sent legitimate mail out before, they hope it bypasses the filters of mailboxes because of the perceived reputation. Send legal notice asap, then dont delay report them to icann.
I have now contacted: - The buyer of these domains - The new owner of the domains - The domain registrar - The hosting provider - ICANN I have also had a legal notice drafted and sent it to the new owner. I will now wait a day or so to see what happens.
None of which, unfortunately, will do squat unless any of them receive legal notices of dispute. You're going to have to potentially sue the parties behind the acts to possibly get them to stop.
To be honest with you, I do not care what they do with the domains. This is not my problem. I just want the content of these websites deleted as it is a near direct copy of our own website.
I have just heard back from their hosting company and this is what they have said: "Please note that below-referenced copyright infringement notice does not substantially comply with the required notification elements of the Digital Millennium Copyright Act of 1998 ("DMCA"). Please note that we have not passed on the substantive merits of your claim." Does this mean that they are not going to do anything?
It means the papers you filed were not what is required under the DMCA. Not sure what the requirements are though.
It seems that you are correct. I have heard back from all that I have contacted and it seems that they are not concerned and nobody is interested so another website (not owned by myself) is now using my own business contact information to spam everything in sight.
It's not that they necessarily don't care, it's that they have to follow accepted procedures so that their own butts are covered. What you need to do is file a standard DMCA complaint as described here: http://www.plagiarismtoday.com.nyud.net:8080//?p=105 Give them all the information and declarations that is needed, in detail, and hopefully they will be shut down.
