    Yes... all they have to do is exist, and they are protected under copyright law.

    Email VBulletin and ask them if you can use the smiley :D in your forum, or maybe they may do it for a small 1 dollar fee who knows the worst they can say is no :)

    Why not make a similar one? You could probably hire someone to make an original work that closely mimics it for under $10. Maybe separate the top and bottom teeth? Make one with a few hairs?
