I wasn't aware such a thing exists... from wikipedia : Under the U.S. law, service marks have a different standard of use in order to count as a use in commerce, which is necessary to complete registration and to stop infringement by competitors. A trademark normally needs to be used on or directly in association with the sale of goods, such as on a store display. As services are not defined by a concrete product, use of a service mark in advertisements is instead accepted as a use in commerce. Heh . Live and learn . I checked again, I think its both TM and SM . Look for 79028137 - this is another Tm/Sm (uTube) registered July 26, 2006, and uses the same time of "Trademark Servicemark" record. I might be wrong though, so correct me if I am .
No you have it correctly. My point was simply trademarks have to be used in order to maintain the right to the trademark.. ..if Coca-Cola stopped using the term Coca-Cola in their advertsing and on their products.....in a few years someone else could use it actively, and in a court of law Coca-Cola could lose the right to it, due to not protecting it via inactivity...
Who would like to guess the value of the domain utube.com if they were to sell. Perhaps they could sell it to youtube.com, I'm sure they would be interested as its their own traffic that's being lost.
Well obviously YouTube would .301 Utube ... ensuring that ALL traffic goes to the correct site. That has to be worth at least $1 million+
I guess it all depends how much they actually make selling pipes...... Maybe youtube should at least host the site for them as a goodwill gesture.
Sure, uTube is getting so many hits, but remember that only a very small fraction (i bet under a thousand or even a hundred) are even interested in "tubes". Even if uTube placed ads, a person's first reaction when they visit a site by mistake is leaving. So now uTube is just getting worthless hits that are crashing their servers, and preventing their "real" customers from getting what they need. Also, changing a company's domain isn't like changing a personal site's domain. It has more work than you think. Remember, they have business cards, flyers, ads, hardware and god-knows-what-else that have their domain name, and updating all of these on their new domain will cost them a lot of money and work, which is why they're offering to change their domain on youTube's expense as an option.
absolutely amazing the amount of comments done without an iota of research. Let me see....stop selling equipment with price ranges of $10,000.00 to $1,000,000.00 plus... to sell adsense or the domain name.... brilliant absofugginglutely brilliant
That company is so stupid. They could actually just shut down their business and make thousands a day off ads.
Where did you come up with such a foolish statement?? Where did you get a business degree??? Your going to tell a company doing probably millions a month to stop and sell ads???? Thats like telling someone to play russian roulette with a loaded glock... Vapid to say the least....
You are going off the deep end here...... Real servers crash from severe loads all the time...that is why there is redundancy built in... and none of that has to do with the poor statements of quit that business and sell ads.... Look around in the real world...advertising has been around since the earliest of times....now that being as it is did all the other business shut down and look to sell ads????????? NO!! Ergo, the many posts saying utube should do so... shows there is little business acumen in the DP forums and terrible advice is rampant.
My thoughts exactly, these guys are sitting on potential pile of cash, but have no idea how to get to it
Sem-Advance, The only one talking nonsense here is your good self. This is a discussion about about a bunch of Rednecks who can't monetise their 'problem' as they see it. The economics of Pipes and Tube are irrelevant. 68million+ visitors PLUS worldwide publicity worth literally millions of dollars are what most companies dream of. The fact that uTube can't in some fashion turn this to their benefit is what makes this state of affairs laughable. By the way, you wanna give me some free SEO advice?
Dear Jack You are very lost if you think 68 mill are mistakeningly landing on utube.com Nice try though... PS Free SEO for escort sites ???? I have a good amount of front page listings on Google for those terms I'll PM you a small list
I don't think that 68+ million are landing on Utube, I know that 68 million visitors are NOT landing on utube. If you read the interviews with Girkins, he speaks of "68m recorded hits in August". That, as we both know, does not equate to visitors. Good idea to go for the pedant angle though - I like that. I guess this means my free SEO ain't gonna happen.
