Using youtube videos on your website - legal issues help.

    Hi,

    Im stuck in a catch-22 here. I have a domain name ready which I want to create a website for trance type music and use videos from youtube then embed them into the website. It will have other content on to such as trance djs, top 10 etc. Just a website related to trance really but with lots of videos from youtube, including remixed versions and unofficial versions etc.

    My question is, what are the legal issues with using music videos from youtube, would I be making myself liable for breaking copyright because I would be embedding the video into my website? My getting alot of mixed answers on this, I have searched youtube / google an im getting alot of different answers, any help would be great, thanks.

    If the video is embeddable on youtube then it's no problem. Youtube has a reponsibility to remove copyrighted content, and/or block copyright content from being embedded on other sites using there technology so... if its embedable go ahead and use it. Lots of sites do... you can even contact the owner of the video and ask for permission.

    I have a similar situation although, it's slightly different. I have Adobe Flash CS5.5 and it won't be an official embed code. Is that still okay?

    If you really want to be secure than I also suggest that you contact the owner of the material. Copyright infringement is really going to heat up and you will most likely have to start taking extra measures such as this in the near future.

    If you are not ripping / stealing the videos from YouTube and use their API's (like I do) than YouTube's API will not play the video once YouTube either takes it down, or the video becomes private and all of the other situations. Though note, YouTube's API does have a TOS that you must follow, including ads on the pages and things of that sort.
