Please bear with me and read the entire post. I need advise. thanks. There's a company called for Example: "Blue Widgets", but they have Blue.com as the domain. The company I want to establish will be called "Blue", and use Blue.net. So it's more or less not the same company name as theirs, their's is 2 words "Blue Widgets", mine just "Blue". The name "blue" is not a generic word. Could pass for a brand name, but it's not a brand name that they came up with. It's a common misspelling of a generic word. For example a generic word such as "Phone" but spelled "Fone". It's like that. I checked the Trademark listing and noticed nothing of that "name" is registered as TM. If I were to use the .net of that domain name, and establish a company myself, will it be in my right to use it? Or will they eventually come after me in the future? Can two companies co-exist with the similar-ish name? We are different as chalk and cheese as far as the company ideology goes. There will be no "bad faith". Our service is completely different to each other. Think Sony and McDonald. Ever more than that. I honestly just really need to establish a company with that "name" for personal reasons. I'm not bothered about the doman name's extension. But the name of the company itself.
As long as your not soliciting the same service/product that the other company is then they cannot do anything about it. If you do promote similar product/services then they can claim that you are gaining from their name and/or advertising and actually get away with taking the domain name from you.
