Hi, i'm currently making a flowers shop website for a client of mine, i was wondering if it's legal to use Teleflora or FTD photos from theres websites. I'm only asking this because almost ever website within the 4-5 Pages of google for the search term "Flowers" Is using the same photos. Thanks for reaching out. Izzy
Photos, just as written words, are copyrighted materials belonging to the producer the moment of production. You would be in violation of intellectual property rights if you had used someone else's photographs on your site, especially in a commercial setting, without explicit permission.
I agree. However, your floral shop customer may have agreements in place with Teleflora and/or FTD, and those agreements may permit the use of those firms' images on the website. Check with your customer, and if they are in an agreement, have them (or perhaps offer to do so for them - for a fee!) review their agreements, perhaps on the companies' websites, to see if the images can be used.
never assume that it's ok to use images just because other parties did as well. Chances are those other florists are part of the teleflora/ftd network so what you see/order is supposed to be the same across the board. If this site you are building is not part of that, you should use images from the actual flower shop just for the sake of showing accurate samples of what's available. Otherwise go to flikr or one of the free images sites (make sure there is license to reuse though!).
