Using Same Templates. How much legal is it?

    Rescently i downloaded a freebie template from a forums freebie section. Later i noticd the ame template was for sale at TM.

    So would it be legal using that template for any sites?
    Secondly its out for sale so no only one person will buy it. There would be manny people using it.Is that fine using same template by manny sites with different contents?

    I would be careful here, one of two things has happened here

    • Someone has created a free template which someone has decided to sell on TM
    • Someone has created a template to sell on TM which someone has decided to make a free download somewhere

    If its the first of those cases, the owner of the template would be within their rights to stop anyone using it who hadnt paid for it.

    If its the second case, and the templates author has agreed it can be freely distrubuted then you would be ok to use it. Depending on the rights given away with the template someone could have the rights to sell it so both cases could be legal.

    If you look in the Zip the template came in, was there any licencing information that would help you clear up which case it was? Otherwise have a look on TM and see if you can contact the seller, and find out the licencing of it. At the end of the day better safe than sorry, or just find yourself another free template.

    As usual IANAL so check before making any decision based on this.

    Thanks for the realy helpfull post. Definately deserve a rep.

    By the way the template has no licence file and it is not even the full femplate its just three pages not the full one. So i think the prson might have been legal owner of it.

    I think you got your explanations reversed from your examples.

    Wouldn't it be:

    Someone has created a template to sell on TM which someone has decided to make a free download somewhere

    So finally i think i should not care for the lisence and use it straight. In eithere case i have an answer for the owner or any one who has objecions from your posts if any problems arise isant it.
