Using my software's name in their software's advertising?

    Saw this ad today while doing a search at download.com:
    For those of you who don't know, I wrote Article Distributor, but they aren't selling Article Distributor. They are selling a program called Article Submitter. I don't care about competition, but the part that bothers me is that they are using the title of my software to sell a different software title. I sent a very polite email to them asking them not to use my software's name as their ad title, but I'm wondering what other rights I have. I do not have a trademark on the name, nor do I know how to get a trademark. I know there have been some lawsuits lately involving trademark infringement in ad buying, but I haven't read any of it. Any suggestions?

    I think that is not registereded anywhere they can use it..Who registered first is the owner :D
