Using famous quotes

    Hi, I was wondering if anyone could advise me of the any legal implications for using quotes from famous people?

    Id use a site like http://www[dot]woopidoo[dot]com to source the quote from.

    I see famous quotes used everyday in newspapers and it seems that you are allowed to quote someone as saying something as long as they have actually said it.

    I wonder if the same applies on the internet? I just want to drop in random motivational quotes from famous people.

    Im not a lawyer, but i beleive you are allowed to use quotes as long as you cite who said it first.

    And, you arent trying to monetize the quote. Meaning= you cant take a quote, put it on a t-shirt and sell it without giving royalties to the person whose quote it is.

    I think thats the way it works. MAke sure you take every effort to show that you arent passing off someone else's idea as your own and you should be ok. If you are really concerned, consult with your lawyer.

    It may depend on the country you are living in (though I think they are all similar in copyright laws).

    Under U.S. copyright law, quotations of works may be used if the use falls under "fair use". The summary of sec. 107 says:
    (Ironic, isn't it, that's I'm quoting a document - this would fall under "fair use" because I'm commenting on the quote above, but since U.S. government documents are generally in the public domain, I'd be in the clear anyway).

    If the quotes you're using were made before about 1922 or 1923, the work has likely fallen into the public domain, which means you can use at your leisure.

    If you're wanting to publish more recent quotations, you should consult the four prongs listed at http://www.copyright.gov/fls/fl102.html to see if your use qualifies. If in doubt, consult an attorney.

    In my understanding, the thing about copyright law is that some lines aren't really all that clear, even after consulting an attorney. Only a judge can interpret the law as it applies to a particular case.

    On second thought, some quotations might not even be protected by US federal copyright law. From the US Copyright Web Site:
    As you can see, spoken quotations "that have not been fixed in a tangible form of expression" aren't covered by copyright. If you're at a speech, for example, you could probably publish the speaker's words without copyright problem.

    Cite your source with the quote.

    A quote is a short excerpt of speech. If for example, John Q Reviewer gives a review on the latest movie and you quote a few sentences and cite properly, it is fine. The most important thing, Journalistically, is to make sure your audience knows the words are his or hers and not yours.

    It can help if you watch the news closely and read the paper. The same rules apply.

    I use quote in my speeches and writing often and have in my library two master books of quotes, which contain about 50,000 quotes. Those are "canned" quotes (IE past quotes of merit). When I am writing a news story and quoting, say, a Senator in a news conference, I cite the source.

    I gather you want to do something like this:

    "Newspapers, magazines, colleges, and all forms of government and religion express the superficial activity of a few, the mass either conforming or not attending"

    Henry David Thoreau 9 Aug, 1858.

    The date is nice when you have it, but the name is the most important item.

    I have seen same quotes on many different websites. A Quote is a saying by a famous person and it is not the property of any website. You may find them from word of mouth, newspapers, friends, websites etc and use them on your websites. Its okay..!

    Famous quotes may not be a property of any site but the fact that they are famous presupposes that they were spoken by someone famous ( or may be someone got famous by saying something that became famous..phew) which means more people than you know of, are aware of that quote so, you can't just hijack them without properly citing the name, for someone crazy and free enough to report that, might report and someone as crazier, might take action.
    I, also, know that unless you are completely out of luck, no one is going to bother about the references you made or did not make. But, it's always better to be safe than sorry. Go for the safest possible way, cite the names with their quote and no one will be able to lay hands on you or your work.
    Yes, the rules remain the same.
