Has anyone had any success using a blog as a means of documenting one's steps in a debt collection situation? Here's an example: http://davewallace.wordpress.com
Well if it turns into a slam blog, there's the potential for libel and stuff...but I guess if it's documenting experiences with factual claims and warrants, then there's kind of a legal penumbra. Technically you're protected (depending on the country) and may be doing a good service promoting awareness of an individuals practices, but it depends on how "Dave Wallace" would interpret the situation, and what he choses to persue.
Nice site. But have you considered the implications of of this site, I mean I'm all for free speech but bear in mind that defamation is literally a false claim or statement that may harm the reputation of an individual. If believe that if you have grounds for your claims that you are in the clear but just keep in mind that although truth is a defense against defamation it is not a defense for invasion of privacy.
Thanks for the insight, this is not my site. I just admired the sincere and honest tone of the writer. The example site seems to be picking up steam: http://davewallace.wordpress.com
Here is a nice little blog about the reverse. The little guy fighting the big bad debt collector. http://www.winn-and-sims.com/ I think the guy who made it runs a web forum or something.
That is a very tricky topic, which is better not to use in this form, especially if the opposite side is legally = financially very strong. They could have found many legal objections, far too easy.
I wouldn't post a thing on a blog like that unless you can also post prof positive that such transactions occurred. I would want to establish a time line on the ordeal with all records relating to the events. Remember, you can't get sued for the truth. If you can establish full legitimacy for all claims made on the site, make it clear what is opinion & what is fact. But, I'm not a lawyer & you should probably consult one before making that publicly viewable. The other company also has to establish that damages have in fact taken place.(ie someone walks away from signing a deal because of what has been posted.. But, in the end they could have the site taken down & that could damage your credibility)
