Use of eBay name in Domain Name

    I know you guys are experts with eBay, alot of eBay affiliates here. But I was wonders I want to register a domain name with the TM eBay in it, something like eBay----.com, but not for eBay's affiliate program.

    Do you think this will be okay with eBay? Or will they send a C&D letter.

    It'll be promoting an eBay guide.

    nope. they're pretty strict about that. even if your site is selling your soul promoting ebay and all its goodness, you'll still get a legal letter from ebay's legal team.

    i know, because i tried :T

    eBay is very aggressive when it comes to their trademark. It would likely be infringement and could get you sued. eBay even sued (and won) against perfumebay.com.

    Yeah, I read about perfumebay.com, but I think they lost because they were actually selling merchandise like eBay.

    I'm selling a eBay guide. Basically if you're suspended by eBay, my guide shows you how to get back on.

    Still bad idea?

    You can't ride the goodwill established by someone else. If you plan on selling a guide to "eBay" it would certainly be trademark infringement.

    There are tons of eBay guides for sale already, I don't think it's a problem. Just do a Google Search 'eBay guide' ads.

    Selling an eBay guide isn't the problem. It's using ebay in a domain name which will be used to sell anything related to "eBay" the trademark/business.

    yeah, don't be dumb... you'll get a C&D letter from ebay's atty's within 10 days of opening the site.

    "sucks" are not considered trademark infringement and are protected free speech - the reason being that it is not likely to cause confusion with the TM holder because the normal consumer wouldn't assume that a "sucks" site is associated with their business. You still need to be careful about what you say about a site.

    It also isn't a commercial site (no advertising, sale or offering of products).
