Urgent - Notice Of Unauthorized Use Of Fox Properties

    Help, i just received this email this minute
    I dont think what im doing is illegal and im not hosting the videos neither am i the uploader, can anyone tell me what to do please i dont want to remove the movie.
    Shall i do what thepiratebay does:p

    This is not difficult. You don't own the rights to show that movie. The rights holder has asked you to cease showing it.

    So, stop showing it.

    Can they sue me for this though, i dont want to show that im being threatend to them, i put hard work into this site and i dont want it shut down

    It's definitely that simple. Just remove the content and all links to the content or else they will have grounds to take things further and have your site removed from Search Engine Listings, complain to your registrar and host and take legal action (sue for damages).

    What you're doing is indeed illegal. The fact that you are not hosting the content nor are the uploader means nothing. That is the reason tv-links got raided and shutdown. You cannot get away with what thepiratebay does because you do not live in Sweden where the law is different. Your site (and I assume you) are in the UK.

    You have two choices: remove the links or let Fox serve your host with a takedown notice (and possibly you with a lawsuit). If you think your host won't comply with the request to have your site shut down, think again. They don't want to be held liable for your actions. They will remove your site quicly at Fox's request.

    Alright, but what about quicksilverscreen peekvid movie-links etc, are they all doing illegal stuff?
    Warez-bb.org Forumw.org links to movies and even movie forums. all im doing is embding the links, is this illegal?
    please i need real legal advice im sure what im doing is not illegal

    Just remove that one link/page they complained about.

    Then tell them in a reply email that it has been removed and ask if they have any other materials they wish you to remove. You can also mention that while you have removed the link, none of the content they complain about was hosted on your site. Most likely that will be the end of it.

    They are not asking you to shut down your entire site.

    Yes, embedding links to infringing material is illegal. How many times does it have to be said to you? In the UK there are a number of lawsuits involving torrent sites. They don't host. They don't even point to actual files (just the torrents). And yet they get shutdown and sued all the time. tv-links was mentioned twice. In the US there was also the Grokster case.

    Forget about other sites that do it. Just because other people do it doesn't mean it's legal. Just because others are not caught doesn't mean they can't come after you. People speed on the streets and rob from stores everyday without being caught. That doesn't make it legal.

    They are not asking you to take down your site, but if you don't comply with the request they will.

    They dont get sued often and when they do they just laugh because nothing can happen to them. They havnt paid one cent to the people who have tried suing them.

    If you plan on pursuing this option, you should hire an attorney who specializes in internet copyright law. You aren't going to get decent legal answers from random people on a message board. You'll have to decide if the expense, time and risk of having your site shut down is worth it.
