Quick Question, I own several domain names that actually contain a trademarked slogan. I received an email from said company stating that I needed to transfer those domain names to their company. I have yet to talk to a trademark attorney but will if I must. Has anyone ran into this issue and if so, did they actually transfer their assests to the other company without some sort of compensation. Thank You
You are not entitled any compensation for turning over a domain that is infringing upon a trademark - in fact, just asking for compensation can be used to prove bad faith. If your domains are indeed infringing, they could sue you for damages and all revenue the site has ever generated.
So the simplest solution would simply turn them over. They are in a parked state. Not income generating, and to be quite honest have not generated much income at all.. The said company simply did a registrar check for any of the words in their slogans trademark and sent these letters.. Again, Not generating, but who wants to give a company with millions your assets...
