Underage Porn Question ;)

    It's nothing like the title says, but it has something to do with it. What I'm thinking about doing is making a site that allows users to upload pictures of them selfs with no limit to how much can be shown. Pretty much it's like a amature porn upload site. What I'm trying to avoid is teens signing up and saying they are over 18. Say the user is 16 and they signup and agree to the t.o.s. saying they are over the age of 18 can I be held responsible for that if something were to happen? Also upon entering anypage on the site you will be asked if you are over the age of 18 if they click yes they can see the site, if they click no then they will be redirected to some other site. What more is needed to legally own a site like this?

    1) have disclaimers all over the place
    2) moderate all pic submissions
    - if you can't moderate all, moderate the 1st couple of submissions from each person.
    - or get some people to help you moderate, there are enough horny buggers out there to help you out.

    as sonig suggested, there is an organisation whihc has a link that you can report the images.
    Or you could have your own form?

    I do not see why you should be able to evade legal responsibility for child porn appearing on your site and/or pictures which individuals have not agree to have posted them to websites.

    Hiding behind a "disclaimer a page" is not enough. Pedophiles could upload images that they claim to be of themselves. In fact, jilted lovers could upload images in an effort to wreck the careers and/or lives of old partners.

    Heck, you might even have pictures uploaded from countries where you could face the death penalty -- and not even know it. Do not forget, ignorance of the law is no defense.

    The only way to avoid problems is to disallow user uploads and obtain your own pictures. That is the only way you can guarantee the most youthful looking are actually adults and that you can guarantee that all pictures are there with the individual's agreement.

    Do as noppid said and read and understand 2257.

    If I remember right, they were updating 2257 to become stricter. (This was awhile back I'm not sure how far it has gone, might want to check with FSC)

    The new rules added would make any webmaster who has adult pictures of any kind must have 2257 documents of every model. Even though they did not produce the pictures.

    You should make it so images need verification from a moderator/admin before going live.

    There is a new porn law out I read somewhere. If your site is in the US then you HAVE to maintain a database which has the real name, real address and real date of birth of anyone on your site who has pictures or videos that are classifed as adult/nude. I think thats the 2257 law people are referring to here. Its levelling the porn industry and pushing all the smalltimers out.

    Will have to read further into this about porn, pictures, etc.

    One of my brilliant ideas was to have an adult image site where people can upload their pics.
    Now I will have to put that idea way, way back until I can get better clarification of the legality.
