I got about 3 emails form a guy who claims he wants to take legal aciton agesnt MKhost.. his email to me: E-mail:: ******* Question:: This is our third email. We require a postal address for your company, can you please provide this. I repilyed back with this. > Hi, > > sorry about the delay in emailing you back, before I give you my Postal > Address I would like to know why you want our address?. > > Thanks. > Then he repilyed this Hi, We require your address so that we can begin legal action adanst your company. Regards, Im not sure what to do? Im quite worried becasue this is a small project for me and my partner.. and we don't want to be taken down
I would assume if he wanted to take legal action he would first send a C&D (Cease and Desist Order) via email first. I would be highly skeptical and would not give out your email. If they want to they can subpoena (legally force) your host to give over your information. Your host won't give it over any other way. Basically, I'd say this is a scam.
You laugh at them, then tell them to have their actual lawyer or law firm look it up from your WHOIS. Then you ask for the law office's name and number. Then call them on Monday.
If it were me I would reply back asking them what legal action - or just ignore it altogether. Most likely this is a scam.
Never give in without first asking DP ;] Good luck, if he gives you an email back shoot one of us a PM.
He sent it nearly 2 hours ago English time, not sure if he will email me back or not. Is it a legal requirement to have a postal address on the website?
NO Do not give them any information whatsoever - They are the ones who should be giving you info - if they are legit, which I am 99.9% sure they are not
I've asked my host why this is happening as well. Do you think they'll actually take legal action on a small web host?
I concur. If they were REALLY in touch with law firms, or whatever. They would know how to do their OWN research. Not be contacting you. Plus if it's a website, they can get it from WHOIS, unless you have it blocked. They could then subpeana your host and get it IF legit. No need for you to turn over anything. Save your convo though. Just in case.
Like what? everything based on MKhost is 100% legit. can't really get any bad reviews, as the only clients i've got is about 5 local's.
No need to worry or be a chicken little. If they had a case, you would know what they are accusing you of. Sounds like a scam.
I dont think you have anything at all to worry about. This type of scam is done often. I have seen may threads here on DP about the same type of thing. Relax and get on with your business and don't worry about this - is my advice
This was the worst of it. Thats were I got worried, something might happen to my project with my partner. edit: with the support of you guys this might just be a parthic scam.
i'd say just ignore it or reply the messages without giving any info of yours. if you feel like "doing" something about it, then look for your resellers (if you offer reseller hosting) and see what one of them is up to. Maybe one of them is abusing your server and ip address is pointing against you.
This guy is basically trying to get some money. I feel like he senses your a new guy in the business and in a bit over your head (no offense). Kind of like a car salesman seeing a prospective buyer "a mile away". Don't even respond further. If you feel compelled to say something, say if they want to do anything else to come with legal documentation or nothing at all.
It is funny how people treat the legal system. When you are taking action, you just need to provide the information to your lawyers. Company or personal addresses can all be researched by the law firm. I never need to personally called up a company asking for their address to sue them. All these are suppose to be done by the law firm. If he is asking that, most likely he is just threatening or doing a DIY letter. Tell them to fax to you an official letter black and white, normally what they dare to do on email, they won't dare to do on black and white. I would advise you not to worry, as and when their lawyer's letter arrive then you can start your actions. Now just carry on with normal life.
