Of course it is a trademark. The first person/comapny to use a mark gets automatic trademark rights for their particular usage. Twitter is also a federally registered mark. If you register a domain that is an attempt to ride the goodwill of another business, it is likely trademark infringement. Any domain with "twitter" in it is going to be infringement if it has anything to do with the type of business they are in.

Be aware twittercraze is not the same as twitter so they are different names and I suppose they can not be considered as the same

You shouldn't post about trademark issues when you obviously have no knowledge of the subject. Including a trademark in a domain is trademark infringement when the service is related. Adding words does not get around infringement. Even "PerfumeBay" lost their domain to ebay - and after spending over $600,000 to fight the case in court. It doesn't even have to be an exact spelling - similar, misspellings, phonetic, and even foreign translations can be infringement i.e. even "twiter" with "two" "T's" instead of three would be infringement.

So basically there trade mark policy says that you can't mislead others with the use of the " twitter name " or for any financial gain using that said name.

I believe that if you're looking to augment the Twitter experience, but are not operating as Twitter does, you won't have a legal issue. There are currently websites out there that provide Twitter usage reporting (twittercounter.com) and that allow local feeds (twitterlocal.net) ...

So, I'd say go ahead with your purchase ...

    Cheers, Hilander

That is not talking about the use of "Twitter" - it is talking about Twitter accounts.

Someone else doing something doesn't make it legal. "Augmenting" the Twitter experience is still trademark infringement and you can be sued (As myspace has done).

Any use of Twitter in a domain name (as it relates to their business) subjects you to a lawsuit or a UDRP, unless you have obtain express permission from the trademark holder. Anyone who says different doesn't have a clue.
