    Don't give up on the directory business on account of one disagreement.

    Like any business endeavor you need to make decisions on when to fight something and when to let it go. Disagreements happen. You can't give up every time work get frustrating. :)

    i dont know about you, you could fight it for another month or so with paypal, but i would refund and move on.

    It always amazes me that people DO NOT READ anything before submitting. You are in the right, but as others have said before, it probably is not worth the hassle even though it is frustrating as hell.

    same thing happen with me with submission in EII, i just told him i have mentioned in my guidelines that we can change the titles and descriptions. So do what u can ;)

    We have added a checkbox on the submission form for submitters; they must agree to the TOS before they can complete their submission. Hopefully, they do review the terms of service. It has reduced the number of complaints about listing titles, descriptions or placement.

    No it isn't correct, a contract was formed when the site offered a link under certain terms and conditions. This submittor was obliged to accept these before submitting. Point of Law was on the side of the directory owner and this could have been stated to paypal.

    This mentality of 'I can't be doing with this crap' is the wrong one, sure we could all do without stress in our lives but we all also need money. I'd have kept the money just for the hell of it and found some real picky way not to include the sumittor. ;)

    Can a contract really be formed without paper and signatures?

    If you own or in the future run a directory yourself you better hope they dont stumble upon that statement right there, it might put them off.

    I agree with the others, I would have refunded and delete the listing. Its a waste of time trying to reason with such people.

    A contract can be formed verbally, by pen and paper, by conduct or even visually such as an email or in my case by reading the webpage. I'm a law student so have a fair bit of knowledge surrounding contract law:)

    Yes of course it can, a contract would be valid if it is written on the back of a fish! A contract is simply an offer and acceptance, if someone offers and the other accepts its a contract and any Court of Law would uphold this.

    As long as you show terms and conditions at the time of offering you don't run the risk of falling foul of the Unfair Contract Terms Act 1977 (c.50), and any other simular laws around the globe.

    @Brian1970; It most certainly is the way to run a business. Bad business is giving refunds just to avoid crap. The seller is correct in this instance if he was wrong I would have said so.

    @mikey; I've got my distinction for my LLB and know how hard it is, good luck it gets easier. :eek: :D

    But how to enforce such laws over the internet? surely it gets messy when you have various laws from various countries, expensive too, is a small matter worth dragging through the courts? again messy, usually avoidable and in Britain at least we have the old saying that the customer is always right.

    Quite random but do you know in Russia that the law is so abused that the Russian Mafia extort about 10 or 20% from the main banks in their country each year and the banks do it just to be able to carry on, no one protects them and most likely top guys are in on the racket.

    On the matter of the customer is always right, we understand that at times of course their not right but you must treat them that way that they are right, its good for business reputation, only if it is a case of fraud or something should a matter be treated so seriously and the business stand its ground to protect itself.

    As law students im guessing you would understand that giving bad or stubborn advice or messages wouldn't do anything good for a business.

    Treat the customers like kings and queens, even when they abuse you, remember they may have had a bad day.

    as much as I respect the right directory owner has to stick to his submission guidelines (as long as theyre there) I still dont think its worth your own distress over it.
    I also dont think that if the total happened to be $200 instead of $20 that the customer would be any less (more probably) harsh in his correspondence
    I wouldnt have much faith in paypal siding with you regarding any online service

    I think ultimately it has to be left to the directory owners discretion as to whether he refunds or not
    Noone likes having to refund, noone also likes having to refund a customer who has a serious attitude problem, but at the end of the day you have to be grateful that you don't act like him..give him the refund and get him as far away from you as possible
