Transfer domain name without registrant's consent

    I have a client whose website is clearly hosted by a guy with a box in his living room. Service is cr*p, website dissapears, no stats,..... :(

    Client has eventually got round to asking him to move the hosting of the website and he's getting a bit funny. Says he can't move hosting 'cos he's on a 2 year contract. :confused:

    Unfortunately the domain name is also registered by same. Is it possible for the client to ask a new registrant to transfer the domain names without permission from the dodgy guy?

    Only the person named as the admin contact on the registration can approve a transfer or unlock the domain. A simple whois will answer your question.

    Yes if you have acess to email that is being used on admin contact then yes you can move :)

    Worse comes to worse, seek legal advice. But try polite diplomacy first.

    Get the administrative contact email under your control somehow being polite and diplomatic, then check whether the status of the domain is REGISTRAR-LOCK or ACTIVE or something else. If its REGISTRAR LOCK you should get it changed to ACTIVE by your registration guy, HOWEVER, please don't do step No. 1 and step No. 2 back to back or the guy will suspect you for a domain transfer. Wait for a while in between the two steps. Then, after you have control of the administrative contact email and the domain's status is ACTIVE, proceed to your new registrar and ask them to transfer the domain for you. Also, make sure that the email you have registered at your new registrar with is the same as the administrative contact email set on the domain you want to transfer, then your registrar will initiate the transfer process and after a few days, you will have your domain at the new registrar.

    Legally your friend is screwed. He doesn't own the domain. There are a few companys that do this. Infact a few that go as far as taking sucessfull domains that there clients have built, and giving there clients a new domain. It's sleazy but they seem to get away with it.

    I would suggest that your friend puts everything on his hard drive, backups of all databases and site stuff. Then goes out and buys a domain and a new host. Then for the next month port the site over and redirect it from the other domain. Then cancel the old account.

    I agree with Shade your client have no right over the domain.That guy who owns the server and domain can do anything just register a new domain and redirect old domain to new one and put the new backup!
