Hi I have a small question. If I register health-monitor [dot] net and I create a website about health. Can I do it or can I risk to lose my domain because of healthmonitor [dot] com The term health monitor is quiet generic. What do you think ? Thank you for your responses, Thomas
I would run a trademark search, a basic word mark search, at USPTO, I did run one of the two word phrase, Health Monitor, and there are live trademarks associated with this term. Data Centrum communications has two - both referring to: newspaper columns, newsletters and magazines regarding health issues and patient education, and for: Electronic publications in the nature of newsletters and magazines in the field of health issues and patient and doctor education recorded on computer media. In that sense, if you were intending on building a website that is in a similar nature to healthmonitor.com, I believe you would be in direct violation of this trademark, and would be liable for damages.
www.USPTrg is the site he mentioned The answer is NO. Such a generic name cannot be trademark infringed unles you make an obvious attempt to copy their website design and/or content . There's actually a story up about this......... Gaymer.org wanted to block the people/public on reddit from have the 'Gaymer' category because it's gotten popular. The .org won't win because the phrase 'gaymer' has been in use since 1988 supposedly. Without viable evidence to support they did create the r-community to damage the '.org' (of all sites), it wont fly in court.
