Trademark Needed For ClickBank Product?

    I'm working on my first product as a CB publisher and I'm wondering if it's necessary to trademark my brand name? Or is selling the product and using the domain name enough to effectively trademark it?

    I searched to make sure no one else was using this name previously and I could find no commercial use of it by anyone. One person had used the name but it was on a non-commercial website that was/is not even indexed by Google.

    So this question is to CB publishers - do you bother going through the process of going through the government and actually getting an official TM for your products? I looked into it and it is expensive and looks to be quite the pain in the ass so that's why I'm asking before going ahead with that task.

    Well usually new products don't have trademarks, because no one is going to use a company's name if it's not popular. However, if you feel that your product is going to be a BIG thing, then trademark it.

    I wouldn't personally do it, unless the gravity of my product was high.

    It depends on how big you think you are going to be, I have a product
    and I did not trademark it. I don't think it is needed, it is a good way
    to protect your brand though

    I think it's going to be absolutely massive :) It's a huge niche and the product itself is far superior to biggest selling products on CB in that niche now. Of course I realize that's really of secondary importance to the marketing and the sales page. We'll see - I'm confident but I'm also sure I'm going to run into a lot of roadblocks on the way to success.

    I am leaning towards not registering the TM as I've read that by owning a brand name domain and then selling something on it (commercial) - it's considered as a trademark even if you don't file the paperwork.
