Linux is certainly a trademark - whether or not a TM owner will take action against someone using their mark in a domain name is always a concern. Almost anytime you use a trademark in a domain name, and its usage overlaps theirs, or is an attempt to ride their goodwill, you face possible action for infringement.

It's really comes down to how aggressive a TM holder is in protecting their mark. If they wanted to take the domain, or sue you, they could.

It is owned by Linus Torvalds. You could try to contact him through the Linux Foundation to see about using it.
