In a case instituted by cosmetics giant L'Oreal, Europe's highest court has ruled that eBay may be liable for trademark infringements by its sellers. The ruling in this case could impact any website that provides a mechanism for sellers to connect with buyers.

While this case dealt specifically with eBay, the concept of holding a website responsible for trademark infringement by its users could have much broader application. It is certainly worth watching for developments in the area.
